Terms of service
Last updated: 28 October 2026
This is a translation for your convenience. Only the German version of these Terms is legally binding.
1. Scope
These Terms of Service (“Terms”) apply to all contracts for the production of videos, for subscriptions and for the use of the customer portal at caprivideo.com (“Capri Video”) between Lou Technologies GmbH, Bessemerstraße 51, 12103 Berlin (“we”, “us”) and our customers (“you”).
Our services are directed exclusively at entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), legal entities under public law and special funds under public law. By placing an order, you confirm that you are acting in the exercise of your commercial or self-employed professional activity.
Your deviating or supplementary terms and conditions do not become part of the contract, even if we do not expressly object to them. Individual agreements, in particular in an Enterprise offer, take precedence over these Terms.
2. Services
We produce animated short videos (usually 10 to 30 seconds) and explainer videos (up to two minutes) based on your briefing, your materials and the chosen style. Each short and explainer video includes three revision rounds. Scope, length and price are determined by the chosen video type and subscription in the version stated on the website at the time of ordering, or by an individual offer (e.g. for special formats).
The sample videos on our website illustrate the respective styles. They are not a commitment that your video will look identical. Within the chosen style and briefing, we have creative latitude.
We review every order before production begins. If a request cannot be fulfilled – for example a particular video language or a special request – we will contact you. If we cannot find a solution after the contract has been concluded, either party may withdraw from the contract; in that case, we will restore any credits already deducted and refund any amounts already paid in full.
3. Use of artificial intelligence and human oversight
We use artificial intelligence (AI) tools to create your videos, including for concept and script drafts, design, animation, voice-over and rendering. AI helps us produce quickly and with consistent quality. Voice-overs are generally generated synthetically using AI.
No video is delivered without review: every version you receive in the portal has previously been viewed, checked and expressly approved for you by a member of our team. Your change requests are also read and assessed by people before they are implemented. Decisions on starting production, approvals and revisions are always made by our team, not by an automated system.
We do not use your content to train AI models and only pass it on to AI service providers to the extent necessary to produce your video.
Please note: components generated with the help of AI may resemble elements that also appear in other works. The extent to which such components are protected by copyright has not been conclusively settled in law; we therefore do not warrant any particular eligibility for protection. Your rights of use under clause 11 remain unaffected.
Where the law requires AI-generated content to be labelled when it is published, you are responsible for such labelling; we will support you with this on request.
4. Customer account
A customer account is required to place orders. Your email address must be verified before you start a subscription or make any other payment. Your information must be accurate and complete. Keep your login credentials and sign-in links confidential and inform us without delay if you suspect misuse. Actions taken via your account are attributed to you to the extent that you are responsible for them.
5. Conclusion of contract
The presentation of subscriptions and video types on our website does not constitute a binding offer.
First video: for the first video of your account, you receive a free watermarked preview including three revision rounds. No payment card is required. Submitting the briefing and requesting included revisions does not create an obligation to buy. If you want to keep the video without a watermark, you start a subscription; the video is then paid for with credits (clauses 7 and 10). If you do not keep it, you pay nothing.
Further videos: from the second video of your account onwards, you order the video bindingly by submitting the briefing. This requires an active subscription with a sufficient balance; the credits are deducted on submission. The watermarked preview and the included revision rounds remain part of the service.
For custom packages, submitting your request is non-binding. We agree the scope, number of videos, included revision rounds, potential purchase price and delivery timeline before production. Agreeing that preview scope does not oblige you to purchase. Watermarked previews and the agreed included revisions are free; payment is required only if you choose to buy the finished videos.
If the content of an order violates clause 12, we may decline the order or withdraw from the contract; in this case, we will restore any credits already deducted and refund any amounts already paid in full.
6. Prices and payment
The prices stated on the website when you subscribe or the prices stated in the individual offer apply. As of these Terms, the Starter subscription costs EUR 99 per month with 2 credits and the Growth subscription EUR 299 per month with 8 credits; the English site uses the same amounts in USD. A short video costs 1 credit, an explainer video 2 credits. Prices in euros include statutory VAT; prices in US dollars exclude any applicable sales tax, which is added at checkout.
You start a subscription in the portal and confirm payment on the Stripe-hosted payment page. We charge the subscription price at the start of each billing month to the payment method saved there until the subscription ends. You pay individual offers by card through Stripe after expressly accepting them. Invoices are provided electronically through Stripe; you manage invoices, payment method and subscription in the portal under “Manage subscription”.
Production starts after you submit your briefing, any required custom scope agreement and our team’s approval. Apart from a subscription you have started or an offer you have expressly accepted, we charge nothing; silence, continued review or requesting included revisions does not create a purchase. Previously submitted orders retain their original price, revision allowance and payment arrangements; this also applies to single purchases at EUR 499 or USD 499 under earlier versions of these Terms.
7. Subscription and credits
A subscription applies to one customer account. It runs monthly and renews for a further month unless you cancel it beforehand. You can cancel at any time in the portal under “Manage subscription”; cancellation takes effect at the end of the month already paid for, and you can keep using the subscription until then. There is no pro-rata refund for the current month. The right to terminate for good cause remains unaffected.
You also switch between Starter and Growth under “Manage subscription”. Switching to Growth takes effect immediately: the price difference for the rest of the current month is prorated and invoiced immediately, and you immediately receive the difference in monthly credits. Switching to Starter takes effect at the end of the current month.
With each successful subscription payment, we credit your account with the credits of your subscription. If a payment fails, there is no entitlement to new credits for that month. Credits are not transferable, cannot be paid out and cannot be bought separately. For the first video, the credits are deducted when you keep it; from the second video onwards, when you submit the briefing. You can see your balance and all entries in the portal under “Subscription & credits”.
Unused credits remain available while your subscription is active, up to a maximum of twice the monthly amount (Starter 4 credits, Growth 16 credits). New credits are only added up to this limit; credits beyond it lapse.
After your subscription ends, any remaining credits stay available for another 30 days. During this time you can use them for existing and new videos as far as the balance allows. After that, the credits expire without replacement.
If our team declines a paid briefing before the first preview or ends the order before the first preview, we restore the deducted credits.
If a subscription payment is refunded or charged back in whole or in part, we withdraw the credits granted from it in the same proportion. If these have already been used, your balance may become negative; a negative balance is offset against later credits. No further credits are granted from a payment that has been fully reversed. New videos require a sufficient balance.
Vouchers grant a one-time percentage discount on the first month of a subscription. They are not transferable, cannot be paid out and do not apply to credit deductions. The amount and validity are stated in the respective voucher.
We announce price changes for active subscriptions by email at least 30 days in advance. They apply from the next billing month after this notice period. Until then, you may cancel the subscription effective when the change takes effect.
8. Your cooperation
A publicly accessible website link is sufficient for the briefing of a short or explainer video. Additional notes, scripts, logos and files are optional. We may ask for clarification if the website is unavailable or essential facts are unclear. Any files you choose to provide must comply with the portal’s format and size limits and must not contain malware; we do not execute programs or scripts in them.
Delays attributable to missing, late or incomplete cooperation extend agreed deadlines accordingly.
9. Delivery times
For short and explainer videos, the first reviewed watermarked draft is available within 24 hours after you submit your briefing. This period runs in consecutive hours, including weekends and public holidays, and includes our team’s review. It covers the first draft; final delivery depends on feedback and revisions. Historical orders retain their originally agreed deadline start.
For Enterprise orders and revisions, we agree deadlines individually. Events beyond our control (e.g. outages of infrastructure or third-party providers, force majeure) extend deadlines by the duration of the impediment.
If we fail to meet a deadline, you may set us a reasonable grace period. If this grace period expires without success, you may withdraw from the contract for the affected video; we will then restore deducted credits and refund amounts paid.
10. Review, revisions and acceptance
You review approved drafts in the portal as previews with a permanently embedded watermark. You can leave comments on specific points in the video or on the video as a whole and submit them together as one revision round. Each short and explainer video includes three revision rounds; custom packages include the agreed number. For your first video, you can use these rounds before deciding on a subscription.
A revision round covers changes within the agreed briefing and style, for example to texts, timing, colours, images or individual scenes. Fundamental changes – for example a new script, a different style, a different language or a substantially different length – are not a revision but a new service.
Once the included revision rounds are used, further rounds are only possible on the basis of an individual offer and your explicit agreement on price and scope. They are not settled in credits; payment follows the offer.
You keep your first video by expressly choosing the specific released version in the portal; if you have no active subscription, you start one through Stripe at that point. The credits for the video are then deducted from your balance, and only then is the original without a watermark unlocked. If you do not keep the video, you owe nothing for the preview and the included revisions. From the second video onwards, the video is paid for when you submit the briefing; after your acceptance, the original is unlocked without a further purchase. No purchase or payment obligation arises from silence or the passage of time. If payment is cancelled or fails, the preview remains available and the original stays locked.
11. Rights of use
Upon full payment – for subscription videos, upon deduction of the credits – you receive the non-exclusive, transferable right, unrestricted in time, territory and content, to use the accepted video for all purposes, in particular to publish, reproduce, edit and use it for advertising. These rights continue after your subscription ends.
We license any third-party elements contained in the video (e.g. music, fonts, icons, stock footage) in such a way that you can use the video as intended; the respective licence terms additionally apply to these elements. Using such elements in isolation outside the video is not permitted.
Project files, source code, templates, themes and tools that we use for production remain with us unless otherwise agreed. You may use drafts that have not been accepted and watermarked previews for review purposes only, not commercially.
We may show the finished video and your company name as a reference on our website and in presentations. You may object to this at any time by email; we will then remove the video within a reasonable period.
12. Your content and third-party rights
You warrant that you hold all rights to the content you provide (including trademark rights and copyrights as well as personality rights of persons depicted) and that its use in the video does not infringe any third-party rights or laws. You indemnify us against third-party claims based on a breach of this warranty for which you are responsible, including reasonable costs of legal defence.
You grant us the rights to your content that are necessary to perform the contract. We use it exclusively for your order and for the reference use of the finished video under clause 11.
We do not produce content that is unlawful, discriminatory, pornographic or misleading or that glorifies violence, nor content that depicts or imitates real persons without their consent. You are responsible for the legal permissibility of your advertising claims.
Insofar as your content contains personal data of third parties, we process it on your behalf. For this purpose, we conclude a data processing agreement with you pursuant to Art. 28 GDPR.
13. Warranty
The statutory rights in respect of defects apply, subject to the following: we are initially entitled to subsequent performance. Creative deviations within the briefing and the chosen style do not constitute a defect. Claims for defects become time-barred twelve months after acceptance; this does not apply in the cases of unlimited liability under clause 14.
14. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act (ProdHaftG), in the event of fraudulent concealment of a defect and to the extent of any guarantee we have assumed.
In cases of slight negligence, we are only liable for breach of a material contractual obligation, i.e. an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely. In this case, liability is limited to the foreseeable damage typical for this type of contract.
Otherwise, liability is excluded. These limitations also apply in favour of our employees and vicarious agents.
15. Storage and availability
Your approved videos and invoices are available to you in the portal for as long as your customer account exists, including after a subscription ends. Please download finished videos and back them up yourself; the portal is not an archiving service. We strive for high availability but do not owe uninterrupted accessibility, for example during maintenance work.
16. Confidentiality
We treat your non-public information and materials confidentially and only disclose them to persons and service providers who need them to carry out your order and who are themselves bound by confidentiality obligations.
17. Cancellation of subscription and account
You cancel your subscription in the portal under “Manage subscription” with effect from the end of the paid month (clause 7).
You may terminate your customer account at any time by emailing us at lukas (at) caprivideo (dot) com. Terminating the account does not replace cancelling an active subscription. Ongoing orders remain unaffected. We may terminate your account with 30 days’ notice; the right to terminate for good cause, for example in the event of violations of clause 12, remains unaffected.
18. Changes to these Terms
We may amend these Terms with effect for future orders. Contracts already concluded are governed by the version in force at the time the contract was concluded. Price changes for active subscriptions are governed by clause 7.
19. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The exclusive place of jurisdiction for all disputes arising from this contractual relationship is Berlin, provided that you are a merchant, a legal entity under public law or a special fund under public law.
Should any provision of these Terms be invalid, the validity of the remaining provisions remains unaffected. The German version of these Terms is authoritative; translations are provided for information purposes only.
